Chris Smooth Contract

This document is an offer and not a valid contract until a deposit is received. Contract must be signed by
C.D. Players Entertainment/Chris Smooth Inc. and client with no changes. Any changes must be initialed by
C.D. Players Entertainment/Chris Smooth Inc. Please sign and return one copy along with the deposit, made
payable to C.D. Players Entertainment/Chris Smooth Inc. , by date on Job order.

In the event of cancellation, C.D. Players Entertainment/Chris Smooth Inc. will withhold part or all of the
deposit (as listed below) for holding your date and for office expenses that have incurred. All cancellations
must be in writing. (Refund process is approx. 30 days.) Failure to comply will result in the forfeit of the
entire deposit. Cancellation Policy: -Prior to six (6) months before the event: 2/3 of the deposit will be refunded. -Six (6) months to 120 days prior to event: ½ deposits will be refunded-120 days prior to event: no refund (no exceptions)

C.D. Players Entertainment/Chris Smooth Inc., its owners and operators, shall not be liable for any claims at
law or equity arising out its presence at the event location address, unless such claims result from negligence
or willful misconduct of C.D. Players Entertainment/Chris Smooth Inc. , its owners, operators or agent. If
any action of law or equity is necessary to interpret or enforce this agreement, the prevailing party shall be
entitles to reasonable attorney fees and costs. But before attorneys are involved, both parties agree to go to
arbitration/mediation first, with the mediator fees to be split by both parties.

C.D. Players Entertainment/Chris Smooth Inc. makes great effort to honor requests for certain performers,
however, if you decide to reserve a particular performer, there will be an additional reservation fee. By
reserving a performer, that person will then be made UNAVAILABLE to anyone else in that time slot. If
because of any unforeseen circumstance, a reserved performer is unable to fulfill that commitment, 100% of
the reserve fee will be refunded, or the reserve fee can be placed on another available performer. While
requests can be made years in advance, the reserve fee will not be received by C.D. Players
Entertainment/Chris Smooth Inc. , prior to 90-120 days before the event

C.D. Players Entertainment/Chris Smooth Inc. requires a smooth, roll-able surface. If your location requires
the transporting of equipment up or down stairs or steps, it must be stated on the contract. Due to the extra
time and/or help requires to safely move the equipment, an additional fee will be charged.

Long distance travel will require mileage and/or hotel fees.

C.D. Players Entertainment/Chris Smooth Inc. is always happy to setup at outdoor sunny locations as long as
shade is provided by the client to protect the equipment and/or performer(s).

Should an event run over the time specified on the job order/contract, overtime will be paid at the time of the
event. Client will be liable to pay overtime according the hourly amount currently charged by C.D. Players
Entertainment/Chris Smooth Inc. Overtime is payable at the event to C. D. Players Entertainment/Chris
Smooth Inc. Failure to pay the overtime will result in 17.75% per month fee of total overtime rate.

While we do our best to make you party fabulous it will be understood by the client that live parties are
subject to unforeseen circumstances. (Examples; blackouts, equipment, dysfunction, static, performer illness,
etc) therefore a certain amount of flexibility is expected of the client.

We will do our best to find your music requests but occasionally substitutes will be made.

Some adjustments may be made to your final bill because if mandatory government taxes on certain items or
due to travel or stair charges.

If stated on job order: Client to place CD Players Entertainment web address and/or logo on ALL forms of
promotional materials for date
listed on job order. (e.g. Internet sites, radio, t.v, all banners
and fliers, etc.) Failure to do so will disqualify you from the discount, as stated on job order, and discount
will be applied to balance on job order and must be paid before set up on date of event.
